Terms of Service

Please read these Terms of Service carefully before using the ANESFHS Burial Sites web application (“the Application”), operated by the Aberdeen and North-East Scotland Family History Society (“the Society”, “we”, “us”). By using this Application you agree to be bound by these terms.
1. About the Application
The ANESFHS Burial Sites Application is a free, non-commercial service provided by the Society to make its memorial inscription records and burial site information available online. It is operated entirely by volunteers for the benefit of family history researchers.
2. Eligibility and access
The Application has two levels of access:
- Public access: anyone may browse burial site locations and view general information without signing in.
- Member / Volunteer access: certain features — including detailed memorial inscription records — are available only to current Society members and registered volunteers. You must sign in using an approved identity provider (Google, Microsoft, or Facebook) and your email address must be registered with the Society.
3. Acceptable use
You agree not to:
- Use the Application for any unlawful purpose or in any way that infringes the rights of others
- Attempt to gain unauthorised access to any part of the Application or its data
- Use automated tools (bots, scrapers, crawlers) to bulk-download data without prior written permission from the Society
- Reproduce, sell, or redistribute the memorial inscription data for commercial purposes
- Impersonate any person or misrepresent your affiliation with the Society
- Upload, transmit, or introduce any malicious code or content
4. Intellectual property
The memorial inscription data, burial site records, maps, and all other content within this Application are the property of the Society or are used with permission. All rights are reserved. Content may be used for personal, non-commercial family history research purposes only.
Transcriptions and data in this Application are the result of many years of volunteer work by Society members. Please acknowledge the Society as the source in any published research.
5. Accuracy of information
The Society takes care to ensure the accuracy of the data held in this Application; however, memorial inscriptions are transcribed from physical stones which may be weathered, damaged, or partially illegible. All records should be treated as transcriptions and verified against primary sources where accuracy is critical. The Society accepts no liability for errors or omissions in the data.
6. Third-party sign-in services
Sign-in is provided by Google, Microsoft, and Facebook. Your use of those services is governed by their respective terms and privacy policies. The Society is not responsible for the practices of those third parties.
7. Availability
The Application is provided on a best-efforts basis by volunteer administrators. We do not guarantee uninterrupted or error-free access. We reserve the right to suspend or withdraw the Application or any part of it at any time without notice.
8. Limitation of liability
To the fullest extent permitted by law, the Society excludes all liability for loss or damage arising from your use of, or inability to use, this Application or its content. Nothing in these terms limits our liability for fraud, death, or personal injury caused by our negligence.
9. Changes to these terms
We may update these terms from time to time. The effective date at the top of this page will be revised accordingly. Continued use of the Application after any change constitutes your acceptance of the updated terms.
10. Governing law
These terms are governed by the laws of Scotland. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
